European Commission launches a public consultation on the Digital Markets Act
On 3 July, the European Commission launched a public consultation as part of the first evaluation of the Digital Markets ACT (DMA). Open to all interested parties until 24 September 2025, the consultation aims to gather contributions regarding the impact and effectiveness of the Report, as well as its ability to address new challenges, such as the implementation of artificial intelligence (AI)-based services.
The DMA aims to ensure fairer and more competitive digital markets, particularly by regulating the practices of so-called gatekeepers, platform service providers with a dominant position. Its enforcement is overseen by a High-Level Group, created by the European Commission in 2023. This group comprises European bodies representing national regulators within the EU, such as the European Board for Media Services, of which ERC is a member.
In this quality, ERC joined the High-Level Group for the implementation of the DMA and was represented by a Member of the Regulatory Board, Telmo Gonçalves, who was elected for this purpose.
At the third meeting of the High-Level Group, held in May 2024, a joint statement on Artificial Intelligence was approved, which acknowledges the risks and challenges posed by the rapid evolution of these technologies, as well as their impact on equity and contestability in digital markets. On the same day, a dedicated AI working group was established, of which ERC is a part, with the goal of analysing the interactions between AI and the DMA and ensuring a coherent regulatory approach that aligns with the Regulation’s objectives.
ERC´s participation in this working group strengthens its commitment to the integrated and effective regulation of digital markets. At a time when various regulations, such as the Digital Markets ACT (DMA), the Digital Services Act (DSA), the European Media Freedom Act (EMFA) and the Artificial Intelligence Act (AI Act), are being applied in combination, active collaboration among competent regulators in areas such as media, data protection, competition, consumer protection and electronic communications is essential.
The public consultation is open to all interested parties, including citizens, businesses and organisations. Contributions can be submitted until 24 September 2025.
